1. Subject and Acceptance
These Terms of Use (hereinafter: the EULA) constitute an end-user license agreement between the employer's administrator who installs and uses the TERMINAL BY JURIST SOFT application (hereinafter: Terminal or the Application) on a device placed at the workplace (hereinafter: the User) and the company JURIST SOFT DOO NIŠ-CRVENI KRST (hereinafter: the Service Provider).
Terminal is intended exclusively for employers (legal entities and entrepreneurs) to provide technical support for recording employee attendance, via QR code display and Bluetooth signal emission. Terminal is NOT intended for private use by natural persons, whereby the application of consumer protection regulations of any jurisdiction is excluded.
The login account for the Terminal is created administratively by the Service Provider, within the B2B relationship with the employer registered as the Service User within the meaning of the General Terms of Use of the JuristBiro platform. By downloading, installing, or using the Terminal, the User confirms that they have read, understood, and accepted this EULA, as well as the Terminal Privacy Policy and the General Terms of Use of the JuristBiro platform.
2. License
Provided that the User complies with this EULA, the Service Provider grants the User a limited, personal, non-exclusive, non-transferable license to install and use the Terminal solely on the device designated for that purpose by the employer, and solely for the purpose of displaying the QR code, emitting the Bluetooth signal, and, upon request, sending the device's location, to support the recording of attendance of the employees of the employer that registered the User.
If the Terminal is downloaded via the Apple App Store, this license is additionally subject to the Usage Rules from the Apple Media Services Terms and Conditions, including the restriction that the Application may not be distributed or made available over a network in a manner that would permit simultaneous use by multiple devices, except to the extent expressly provided for by the Application's functionality (one Terminal account per physical device/location).
3. Ownership and Intellectual Property
Terminal, including all software code, design, and textual and graphic content, constitutes copyrighted work and is the exclusive property of the Service Provider, in accordance with the Law on Copyright and Related Rights of the Republic of Serbia and Article 7 of the General Terms of Use of the JuristBiro platform. This EULA does not transfer to the User any ownership rights in the Application.
4. User Obligations
The User undertakes to: (i) place the device with Terminal installed in a physically secure location, out of reach of unauthorized persons; (ii) ensure the stable internet connection required for the Application to operate; (iii) accurately enter and update the selection of the work location to which the Terminal is assigned; (iv) use the "Send location" function in accordance with its intended purpose (a one-time confirmation of the device's own location); and (v) inform its employees that a Terminal emitting a QR code and/or Bluetooth signal is used at the workplace for attendance-recording purposes.
The User is solely responsible for the physical security of the device, the accuracy of the configured work location, and the lawfulness of using the Bluetooth/GPS functions in accordance with local labor and personal data protection regulations applicable to the employer.
5. No Warranty
Terminal is provided "as is" and "as available," without any warranties, express or implied, to the extent permitted by applicable law. The Service Provider does not guarantee uninterrupted operation of the Application or the accuracy of the recorded location, given its dependence on the technical characteristics of the device and the internet connection.
For Terminal downloaded via the Apple App Store: in the event of any failure of the Application to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the Application, if any, paid by the User; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
6. Limitation of Liability
The Service Provider shall not be liable for any indirect, incidental, or consequential damages that may arise from the use or inability to use the Terminal, in accordance with Article 5b of the General Terms of Use of the JuristBiro platform, which applies in full to the Terminal. The Service Provider is specifically not liable for consequences arising from an incorrectly entered or outdated work location, physical relocation of the device without updating the location, or misuse of the QR code/Bluetooth signal by third parties beyond the Service Provider's control.
7. External Services
Terminal may use third-party services (Firebase Analytics, Firebase Crashlytics, Sentry) described in the Terminal Privacy Policy. The User uses these services at their own risk, to the extent they are visible to the User at all, given that these are background diagnostic services.
8. Third-Party Beneficiary (Apple App Store only)
For Terminal downloaded via the Apple App Store, the User and the Service Provider acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that Apple will have the right to enforce this EULA against the User as a third-party beneficiary thereof.
9. Governing Law and Jurisdiction
This EULA is governed by the law of the Republic of Serbia. All disputes shall be resolved amicably, and if this is not possible, the exclusive territorial jurisdiction of the competent court in Niš, Republic of Serbia, is agreed upon, in accordance with Article 9 of the General Terms of Use of the JuristBiro platform.
10. Relationship to Other Contractual Documents
This EULA constitutes a supplement to the General Terms of Use of the JuristBiro platform, which remain in effect in the relationship between the Service Provider and the employer. With respect to the relationship between the Service Provider and the administrator who downloads the Terminal via the Apple App Store or Google Play, this EULA applies; with respect to the broader contractual relationship with the employer (service packages, billing), the General Terms of Use of the JuristBiro platform apply.
